Unsolicited Material Policy

HER Interactive, Inc. (“HER”) does not accept unsolicited information or material of any kind, including, without limitation, any ideas, suggestions, concepts, characters, formats, pitches, stories, treatments, scripts, merchandise, artwork, drawings, photographs, videos, audiovisual works, musical compositions, lyrics, sound recordings, and/or other similar creative works (collectively, “Unsolicited Material”). Any Unsolicited Material sent to us by any means will be deleted, destroyed and/or returned, at HER’s sole discretion, and will not be read. The purpose of this policy is to avoid potential misunderstandings or disputes that may arise if any work developed by or under the direction of HER seems similar to any Unsolicited Materials submitted to HER. Therefore, any similarity between any Unsolicited Material and any element in any HER work would be purely coincidental.

If you choose to disregard this policy and submit Unsolicited Materials regardless, then you hereby acknowledge and agree that: 1) HER assumes no obligation to treat as confidential Unsolicited Material and will not be liable for any use or disclosure; 2) the Unsolicited Material will automatically become the exclusive property of HER; 3) HER will have the unfettered right throughout the universe in perpetuity, without any credit, compensation, or notice to you, to use, reuse, modify, alter, display, archive, publish, license, perform, reproduce, disclose, transmit, publish, broadcast, post, sell, translate, create derivative works of, or distribute in all media now known or hereafter devised for any purposes whatsoever, commercial or otherwise; 4) you hereby waive any moral rights you may have in and to any of your Unsolicited Material, even if such material is altered or changed in a manner not agreeable to you; 5) you waive the right to make any claim against HER, its parent or affiliates relating to or arising out of HER’s actual or alleged exploitation or use of any Unsolicited Material.
